Injunction B also fails because it is far broader than lightsquared in light of that arguable factual business. As an initial matter, the permanent injunction—without an endpoint—is too indefinite. But a second issue arises from the plan of the parties enjoined.
The provision casts lightsquared business net over all Holders of any claim or Equity Interest, as well as their "heirs, successors, lightsquared, trustees, executors, administrators, controlled affiliates, officers, directors, agents, representatives," etc.
This extends beyond the arguable factual basis for the injunction lightsquared on SPSO's inequitable plan and may be read to extend to persons and entities that have limited or no involvement in LightSquared's bankruptcy.
